A Justice of the Peace, on the other hand, is only allowed to notarize documents when the notary public is a full function notary or an associate notary public and can also only notarize documents when they are a Justice of the Peace.

On September 15, 2015, Texas Senate Bill 1773 was signed into law. This is a change to the previous law that required documents with affidavits be notarized with a notary public or a Justice of the Peace and that the affidavit be completed in all black ink.
